BAIL FOR SALMAN KHAN TILL JULY...

HYDERABAD: Bollywood superstar Salman Khan's five-year prison sentence for killing a homeless man with his SUV after a night out drinking 13 years ago was suspended Friday pending a fresh appeal.
The actor was on Wednesday found guilty at a sessions court of culpable homicide and other charges for driving his vehicle into a group of homeless men sleeping rough in suburban Mumbai in 2002.
But on Friday, lawyers for Khan argued to Mumbai's High Court that their client's conviction should be overturned. The court agreed to suspend the sentence until an appeal is heard. The decision means the actor's jail sentence does not take effect. The appeal will be heard in July.
"He has been on bail for a long time and his liberty was not curtailed. Normally, in such cases, the appeal is admitted and an accused is granted bail," Justice Abhay Thipsay said, while staying his conviction and granting him bail.
Deciding the conditions of bail, Judge Thipsay asked if Salman's passport was with him and was told that it was in the possession of the Bandra police and the actor routinely sought its permission before going abroad. 
Earlier, the court admitted Khan's plea against conviction and heard arguments of the prosecution and defence.
The High Court asked Salman Khan to surrender before the sessions court and furnish fresh bail bond of Rs 30,000. 
Defence counsels Amit Desai and Shrikant Shivade said the sessions court had failed to appreciate the fact that four witnesseses had maintained there were four persons present in the Toyota Land Cruiser when the accident took place on September 28, 2002, and that it was Salman's driver Ashok Singh who was at the wheel.
On Wednesday, sessions court D W Deshpande judge found Khan guilty of all charges, including driving while under the influence of alcohol and without a licence.
Judge Deshpande had rejected Khan's claim that his driver was to blame and sentenced the 49-year-old to five years in prison. The High Court had granted Khan an interim bail hours after the sessions court judgement because he had not received the detailed sessions court order.
During the trial, the defence claimed that Khan had been drinking water and had climbed out of the car through the driver's seat after the accident because the passenger side door had been damaged.
But several prosecution witnesses, including survivors of the crash, testified that Khan was driving the vehicle when it ploughed at speed into the men sleeping on the street near a bakery in September 2002.
There was a lot of commotion outside the High Court as the hearing proceeded -- sporadic protests against bail to the actor and a fan also allegedly tried to commit suicide, demanding that he be jailed instead of the actor.
